Prize draw - Conditions of participation

These conditions of participation regulate participation in the prize draw “[Shoe give-away]” of Paul Green Gmbh, Haag 10, 5163 Mattsee Austria (hereinafter referred to as “Paul Green”) by the participants, and the collection and use of the data disclosed by or collected from the participants. 
By participating in the prize draw, participants declare their acceptance of these conditions of participation. 
 

Participants take part in the prize draw through the Paul Green Facebook page.
Participation in the raffle is free of charge.
Participation in the prize draw is open to all legally competent persons above the age of 16  residing in Germany, Austria, or Switzerland. Employees of Paul Green and employees of cooperating partners that are or have been involved with the preparation or execution of the prize draw are excluded from participation.
Each participant can only enter the prize draw once. If a participant enters the prize draw more than once, only their first entry will be included.
Registration for the prize draw is granted automatically at the time of entry.
 

The period to submit entries for the prize draw shall begin on 15.04.2024 and end on 30.04.2024 at 23:59 o'clock.
The prize draw shall be held after the end of the entry period. 
The winner shall be selected from all participants by a random generator.
The name of the winner shall be published promptly on Facebook and the winner shall be informed via Facebook message or, if an e-mail is available on their profile, to the e-mail address provided, or by mail to the mailing address provided, and asked for a confirmation as well as for their delivery address.
Delivery/handover of prizes shall be coordinated individually with the participants.
If the participant does not respond within fourteen days, or if a participant has provided incorrect information, the prize may be transferred to another participant.
The prize cannot be paid out in cash or non-cash commodities, nor can it be exchanged or transferred to any other person. Participants may waive their prizes.
If a winner drops out of the competition, the prize shall be randomly awarded to a new winner from among the participants through a new draw. 

The main prize is our SUPER SOFT Pauls 5335-00X.

Participants shall have no legal entitlement to the execution of the prize drawing, nor to the above-mentioned processing of the prize draw. Participants shall have no legal entitlement to take part in the competition. Paul Green is entitled to cancel the prize draw prematurely and to exclude participants. If a participant is excluded because of an error in the execution of the prize draw or because it is canceled, for instance, Paul Green shall not incur any liability because of this.
Otherwise, Paul Green’s liability for slight negligence shall be excluded.
 

The personal data of participants in the “Shoe give-away” prize draw shall be processed by Paul Green Gmbh, Haag 10, 5163 Mattsee, Austria, info@paul-green.com, +43 6217 5323 for the purpose of carrying out the prize draw in accordance with Art. 6 para. 1 lit b GDPR, based on the prize draw agreement.
In addition, if the participant checks the newsletter check box, their personal data shall be processed for the purpose of electronic direct marketing via e-mail, based on their voluntary consent in accordance with Art. 6 para. 1 lit. a GDPR and Sec. 174 TKG (Telecommunications Act), until such consent is revoked.
The winner’s data shall be transmitted to the bank for the purpose of paying out the prize, or to a shipping service provider in order to send the prize, as well as to fulfill Paul Green's obligations under tax law towards tax consultants and financial authorities resulting from the prize draw.
Data shall be transmitted to other recipients not named in this contract data privacy declaration only in accordance with the law or in coordination with the winner.
The participant shall have no legal or contractual obligation to provide personal data. If the participant does not provide the personal data required by Paul Green in order to carry out the prize draw, then the participant shall not be able to take part in the prize draw.
If the participant does not provide the personal data required by Paul Green in order to send the newsletter or does not grant their consent to send the newsletter, then the participant shall not receive the newsletter.
The winner’s personal data shall be stored for at least seven years, or for a longer term in certain cases as indicated in the BAO (Austrian Federal Tax Code), in order to fulfill the statutory obligations pursuant to Sec. 132 para. 1 BAO.
Personal data of newsletter recipients shall be stored until consent to do so is revoked.
If you take part in a Facebook prize draw, your personal data will be processed in collaboration with Meta Platform Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland as the contract processor. When you created your Facebook profile, you were informed that the Facebook group will transmit your personal data to the USA. The legal basis for data transmission to the USA is your consent in accordance with Art. 49 para. 1 lit a in conjunction with Art. 6 para. 1 lit a GDPR. Before granting your consent, you were informed that the USA does not ensure a level of data protection conforming to EU standards. In particular, US secret services can access your data without you being informed of this, and without you having any legal recourse against such access.
The participant is entitled to revoke their consent at any time after it is granted. If consent is granted in writing, it may only be revoked in writing; if consent is granted to receive electronic advertisements, it may also be possible to revoke such consent by clicking the unsubscribe link. If consent is revoked, processing shall be halted unless there is another legal basis for processing. The legality of data processed up until the time of revocation shall not be affected.
The participant is entitled to object to the processing of their personal data for the purpose of direct marketing. If they withdraw their consent, the participant’s personal data will no longer be used for direct marketing purposes.
The participant has the right to receive information regarding their personal data, the right to request the rectification and deletion of personal data, the right to restrict data processing, the right to data portability and the right to submit complaints to a data protection supervisory authority. In addition to these conditions of participation, the relationship between Paul Green, the participant and Facebook is regulated by the Facebook terms of service at https://www.facebook.com/terms.php: These shall apply additionally, and the regulations of these conditions of participation shall take precedence over them insofar as they are relevant. 
Paul Green is the sole organizer of this prize draw. Facebook has no connection to this prize draw, and does not sponsor, support, or organize this prize draw in any way. With their participation, all participants release Facebook entirely from any claims. Facebook shall not have any obligations or entitlements as a result of the prize draw. 
All inquiries and information regarding the prize draw must be directed to Paul Green, and not to Facebook. 

Any cash pay-outs and legal recourse are excluded.
Only Austrian law shall apply, excluding international conflict of law rules.
If any of these provisions are or become invalid, this shall not affect the validity of the remaining provisions.
